What is a money transmitter license?

A money transmitter license (MTL) is required by state regulators for any company that transmits money or monetary value on behalf of others. This includes payment processors, remittance companies, digital wallet providers, cryptocurrency exchanges, and any fintech that moves funds between parties. Most US states require an MTL before you can legally operate, and each state has its own application process, fees, net worth requirements, and surety bond amounts. The license is typically filed through the NMLS (Nationwide Multistate Licensing System).

How many states require money transmitter licenses?

Currently, 49 states plus the District of Columbia require some form of money transmitter or money services business license. Montana is the only state that does not require a money transmitter license. However, even Montana-based companies need licenses in every other state where they have customers. Each state has its own regulatory agency — from the NY DFS to the CA DFPI to the TX DOB — with different application requirements, fees, surety bond amounts, and processing times. What is FinCEN MSB registration?

FinCEN (Financial Crimes Enforcement Network) requires federal registration as a Money Services Business (MSB) for companies engaged in money transmission, currency exchange, check cashing, prepaid access, or dealing in convertible virtual currency. MSB registration is a federal requirement separate from state licensing — you need both. Registration must be completed within 180 days of starting operations and renewed every two years. FinCEN registration also triggers BSA/AML compliance obligations, including developing an anti-money laundering program, filing suspicious activity reports (SARs), and maintaining customer records.

Do I need a BitLicense?

If you engage in virtual currency business activity involving New York residents, you likely need a BitLicense from the NY DFS. This covers receiving, storing, transmitting, converting, buying, selling, or issuing virtual currency. The BitLicense is one of the most demanding fintech licenses — it requires detailed business plans, BSA/AML programs, cybersecurity policies, audited financials, and extensive background checks. Processing times typically run 12–24 months. Some companies qualify for a limited-purpose trust charter instead. We handle the full BitLicense application process.
